Terms and Conditions of Sale

Article 1: Scope of Application
These general terms and conditions of sale apply to all transactions concluded with ADGES Business Development LLC. A "customer" is defined as any individual or legal entity making an order with ADGES Business Development LLC that is validated through a secure digital payment, by check, or in cash.

Article 1 bis: Target Audience and Age Limitations
ADGES Business Development LLC aims to offer a range of products and services available to all audiences. However, age restrictions apply: Only individuals aged 16 and over can place orders through our secure payment platform, by check, or in cash. We strive to restrict access to our sites, products, and services to minors. Any customer not meeting these criteria (age over 16) will be immediately refunded, and a return of the concerned product(s) will be required. Although the content of our products and services is not offensive and could, under certain conditions, be suitable for children, we prefer that our "paying customers" be a mature audience capable of understanding the implications and responsibilities of the business world.

Article 2: Orders
Any order placed on a site owned by ADGES Business Development LLC implies full and unconditional acceptance of these general terms and conditions of sale.

Article 3: Prices
Prices are stated in euros, excluding VAT and shipping and handling fees. The price of items can be changed at any time. However, the price applied to an order will be the one announced at the time of the order.

Article 4: Payment
Payment is due immediately on the date of the order, including for pre-ordered products. You may make payments via credit card or bank check. Cards issued by banks located outside of France must be international credit cards (Mastercard or Visa). We do not accept American Express. Online payments by credit card are secured through accredited financial companies in France and internationally. The information transmitted is encrypted by state-of-the-art software and cannot be read during transmission over the network. Any guarantee regarding the security of this system is entirely the responsibility of the bank and cannot be attributed to us.

Article 5: Delivery
Delivery is made to the address you specified during your order (therefore, pay special attention to the spelling of the address you enter, especially the postal code). The risks are your responsibility from the moment the ordered products have left our premises. However, in the case of a lost package, we will take the necessary steps to ensure that you still receive your product or that you are refunded according to your warranty.

Article 6: Pre-order
For products available for "Pre-order," meaning those that you can purchase before their official release, payment is due immediately at the time of the order. The estimated release dates of the products are not binding. We do our best to adhere to the estimated dates we provide; however, the actual dates often depend on factors beyond our control (e.g., printing delays, DVD pressing delays, natural disasters)... If you want to be absolutely certain that your product will be shipped on a specific date and you are of an impatient nature, PLEASE DO NOT PLACE PRE-ORDERS and only buy the product after its official release.

Article 7: Return and Refund Conditions for Professionals
For professionals, the right of withdrawal does not exist under French Business Law; however, from day one, we decided that our professional clients should also enjoy some security. However, this guarantee varies depending on the product. Therefore, the conditions listed below may be replaced by those specified on your order page for a given product, as the promises made on this order page take precedence over the conditions below.

Article 7.1: Concept of "Necessary Steps"
Some of our contracts involve training services. Our training sessions often include action plans, suggestions, and recommendations that we ask the client to implement to achieve the competence or result aimed for by the training. Before any refund, ADGES Business Development LLC will require the client to present proof of having taken these Necessary Steps. This proof must be provided no later than 7 working days after ADGES Business Development LLC has acknowledged receipt of the refund request. Please note that no refunds are granted once the client has benefited from their training if their order includes one.

Article 7.2: Refund Conditions for Remote Purchases (Internet or Phone)
Electronic Products: Unless otherwise stated on the product description page, our electronic products are non-refundable.
Services: Unless otherwise stated on the product description page, all our services are refundable on a case-by-case basis. The money-back guarantee does not apply to workshops that have not been fully paid by the date of participation.
*Refunds are subject to the completion of the Necessary Steps (see Article 7.1) and our Specific Terms of Sale (see Article 7.4)

Article 7.3: Refund Procedures
Refunds will be made to the client's bank within a maximum period of thirty (30) days from the date a written request, by email with acknowledgment of receipt, is received by ADGES Business Development LLC. An email will notify the client of the approval of this refund and the amount of the bank transaction. All refunds will be processed using the payment methods used by the client at the time of purchase. Our refunds do not cover exchange rate differences; we only refund the euro rate indicated on our order forms, excluding exchange fees.

Article 8: Availability and Presentation
Orders will be processed within the limits of our available stock or subject to availability from our suppliers. In case an item is unavailable for a period longer than ten business days, you will be immediately informed of the expected delivery times, and the order for this item can be canceled upon request. The customer may then request a credit for the amount of the item or a refund. The photos of our electronic products are "suggestions of presentation," meaning that the images do not always exactly match the product you will ultimately receive, especially for pre-orders, where the visuals are not always final.

Article 9: Protection of Personal Data
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access and rectify your personal data. We declare all our files to the National Commission on Informatics and Liberty (CNIL). By agreeing to these general terms and conditions of sale, you acknowledge having read our policy on the protection of personal data and consent to our collection and use of this data.

Article 10: Applicable Law
The general conditions detailed in this document are governed by French law. In the event of a dispute arising between the Client and ADGES regarding the interpretation of these conditions or the execution of the contract, an amicable solution will be sought. Failing that, the Courts of Paris will have exclusive jurisdiction to resolve the dispute.
